These Terms of Service ("Terms") govern your access to and use of the Aldvane website, online store, content, products, and related services.

Throughout these Terms, "Aldvane," "we," "us," and "our" refer to the store operating https://aldvane.com/.

By using our website or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy, Shipping Policy, and Legal Notice.

Nothing in these Terms limits any mandatory consumer rights you may have under the law that applies to you.

1. Eligibility and personal use

You must be at least 18 years old, or the age of majority where you live, to place an order. Products are sold for personal, non-commercial use unless we agree otherwise in writing.

You must provide accurate billing, delivery and contact information and be authorised to use the payment method submitted.

2. Products

Aldvane sells consumer wellness and comfort devices for home use, including the Aldvane Triphase Massager, a powered device combining gentle traction, warmth and vibration.

Our products are not medical devices. They are not intended to diagnose, treat, cure or prevent any disease or medical condition, and they are not a substitute for professional medical care. If you have a health condition, or if you are unsure whether the product is suitable for you, speak to a qualified healthcare professional before use.

We take reasonable care to describe products accurately. Colour, finish and packaging may vary slightly because of screen settings, permitted manufacturing variation, or packaging updates. A variation does not override a specific description or your right to receive goods that match the contract.

Product images, demonstrations and descriptions do not guarantee an identical experience for every user. Individual results vary.

Any express product claim, description or promise that forms part of your purchase remains binding. General variation language does not cancel an express promise or a mandatory legal right.

3. Product use and safety

Read the instructions supplied with the product before first use, and follow them. Keep them for future reference.

3.1 Who should not use the product without medical advice

Do not use the product, and speak to a qualified healthcare professional first, if any of the following apply to you:

  • you are pregnant, or think you may be pregnant;
  • you have a pacemaker, defibrillator or any other implanted electronic or metal device;
  • you have had recent back, spine or abdominal surgery;
  • you have a spinal fracture, spinal instability, spondylolisthesis, or a disc problem currently under medical treatment;
  • you have osteoporosis or any condition that weakens bone;
  • you have or have had cancer or a tumour, or you have unexplained back pain that has not been assessed;
  • you have deep vein thrombosis, a blood clot, a clotting disorder, or you take anticoagulant medication;
  • you have reduced skin sensation, numbness, or any condition that affects your ability to feel heat, including diabetes and peripheral neuropathy;
  • you have impaired circulation;
  • you have severe high blood pressure or a cardiovascular condition;
  • you have an open wound, burn, rash, recent scar, skin infection or skin condition where the product would be used;
  • you have a fever or an acute inflammatory condition; or
  • you are under 18 years of age.

3.2 Heat safety

The product produces heat. To use it safely:

  • do not use it while asleep, or at a time when you are likely to fall asleep;
  • do not exceed the session length given in the instructions;
  • check your skin regularly during use, and stop immediately if you notice redness, soreness, blistering, dizziness or nausea;
  • do not use it on skin that is numb or that has reduced sensation;
  • do not use it together with topical creams, ointments, heat rubs or medicated patches;
  • do not place blankets, cushions or other padding over the product while it is in use; and
  • allow the product to cool before storing it.

Prolonged contact with a warm surface can cause a burn even at temperatures that feel comfortable, particularly for people with reduced sensation.

3.3 Electrical safety

  • Use only the power lead or charger supplied with the product.
  • Do not use the product if the lead, casing or any part of it is damaged.
  • Do not use the product in a bath or shower, or anywhere it may get wet.
  • Do not cover the product while it is charging.
  • Keep the product and its lead away from children and pets.
  • Do not attempt to open, modify or repair the product.

3.4 Stop use and seek medical advice

Stop using the product and seek medical advice promptly if you experience:

  • increased or severe pain during or after use;
  • new or worsening numbness, tingling or weakness in your legs;
  • any loss of bladder or bowel control; or
  • any skin injury, burn or blistering.

3.5 General

Use the product only for its intended purpose and as described in the instructions. Stop use and contact us if the product does not operate as described.

4. Orders and contract formation

Displaying a product on the website is an invitation to place an order.

When you submit an order, you offer to buy the selected products. An automated order acknowledgement confirms receipt but does not necessarily mean the order has been accepted. The contract is formed when we confirm acceptance or dispatch, unless applicable law treats it as formed earlier.

We may reject or cancel an order before acceptance for a genuine reason, including:

  • payment failure or suspected fraud;
  • an obvious pricing or description error;
  • product unavailability;
  • a delivery destination we do not serve;
  • a legal or safety restriction; or
  • reasonable evidence of abuse of a promotion or commercial guarantee.

If we cancel an order after taking payment, we promptly refund the affected amount.

5. Prices, currencies, taxes and payment

Prices are shown in the currency displayed at checkout. The total amount payable, including product charges, delivery charges, and any sales tax, VAT or GST we collect, will be shown before you place the order. Optional charges are not added without your express consent.

Payment is processed through the methods displayed at checkout. We may conduct reasonable authorisation, fraud-prevention and security checks.

6. Promotions, discounts and bundles

A promotion, discount, or bundle (including flash sales and multi-buy offers) may have a stated end date, qualifying product, minimum spend, usage limit or non-combination rule. Material conditions will be presented clearly before purchase.

We may withdraw a promotion prospectively, but will honour an accepted order unless there is a lawful reason not to. We may refuse duplicated, fraudulent or abusive use of a promotion.

7. Delivery

We deliver to the United States, the United Kingdom, Canada (excluding Quebec), Australia and New Zealand, and to other destinations where shown as available at checkout.

Delivery dates shown at checkout or in our Shipping Policy are estimates unless we expressly state a guaranteed date. We will ship and deliver within the period promised and comply with any mandatory delivery deadline that applies to your order.

8. Cancellations, returns, refunds and guarantee

Our Refund Policy explains:

  • your legal rights, including the right to cancel within 14 days if you are in the United Kingdom, and consumer guarantees in Australia and New Zealand;
  • remedies for defective, damaged, incorrect or misdescribed products; and
  • our voluntary 90-Day Money-Back Guarantee, which is handled by email and resolved case by case.

The 90-Day Money-Back Guarantee is additional to, and does not reduce, any mandatory legal right you may have.

9. Intellectual property

Website text, branding, original images, design, graphics, videos and other content are owned by or licensed to Aldvane and protected by applicable intellectual-property law.

You may access the website for personal shopping. You may not reproduce, scrape, republish, sell or commercially exploit protected content without permission, except where the law allows.

10. Acceptable use

You must not:

  • use the website unlawfully, fraudulently or abusively;
  • interfere with its security or operation;
  • introduce malware or harmful code;
  • submit false payment, identity or delivery information;
  • infringe intellectual-property, privacy or other rights;
  • scrape or harvest data in breach of law or our rights;
  • misuse discounts, refunds, chargebacks or the commercial guarantee; or
  • buy products for unauthorised resale.

11. Third-party services

We use third parties such as Shopify, payment processors, fulfilment providers and carriers. Their independent services may have their own terms. Using a supplier, platform or carrier does not transfer to the customer any responsibility that applicable law places on Aldvane as the seller.

12. Website availability and accuracy

We aim to keep the website available and accurate but do not guarantee uninterrupted access. Nothing in this section permits materially inaccurate product, price, delivery or legal information, or removes a remedy arising from an accepted order.

13. Responsibility and limitations

We are responsible for losses that applicable law makes us responsible for, including reasonably foreseeable losses resulting from our breach of these Terms.

Because products are sold for personal use, we are not responsible for business losses such as lost profit, lost revenue or business interruption, where the law permits that exclusion.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

  • death or personal injury caused by negligence where such liability cannot be excluded;
  • fraud or fraudulent misrepresentation;
  • defective or unsafe products where liability cannot be excluded;
  • the consumer guarantees under the Australian Consumer Law and the New Zealand Consumer Guarantees Act; or
  • any other mandatory consumer right or remedy.

Any limitation or exclusion applies only to the maximum extent permitted by applicable law.

14. Applicable law

Wherever you live, you keep the benefit of the mandatory consumer protection rules of your country of residence, and you may bring proceedings in your local courts where the law gives you that right. Nothing in these Terms removes that protection.

15. Events outside reasonable control

If an event outside our reasonable control delays performance, we will take reasonable steps to reduce the effect and provide any notice or remedy required by law.

16. Changes to these Terms

We may change these Terms prospectively. The Terms in force when an order was accepted normally govern that order.
