These Terms of Service ("Terms") govern your access to and use of the Spooky Dream website, online store, content, products, and related services.
Throughout these Terms, "Spooky Dream," "we," "us," and "our" refer to the store operating https://spookydream.com/.
By using our website or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy, Shipping Policy, and Legal Notice.
Nothing in these Terms limits any mandatory consumer rights you may have under applicable law.
1. Eligibility and personal use
You must be at least 18 years old, or the age of majority where you live, to place an order. Products are sold for personal, non-commercial use unless we agree otherwise in writing.
You must provide accurate billing, delivery and contact information and be authorised to use the payment method submitted.
2. Products
Spooky Dream sells novelty Halloween products, including light-up, battery-operated trick-or-treat buckets intended for use by children under reasonable adult supervision.
We take reasonable care to describe products accurately. Packaging, colour, glow appearance and design may vary slightly because of screen settings, permitted manufacturing variation, or packaging updates. A variation does not override a specific description or your right to receive goods that match the contract.
Product images, demonstrations, reviews and descriptions do not guarantee an identical experience for every buyer.
Any express product claim, description or promise that forms part of your purchase remains binding. General variation language does not cancel an express promise or a mandatory legal right.
3. Product use and safety
Use the product as directed and in a manner appropriate for the age of the child using it. Adult supervision is recommended, particularly for young children, given the presence of small parts, straps and batteries.
The product uses standard AA/AAA batteries. Follow standard battery safety practices: use the correct battery type and size, do not mix old and new batteries, remove batteries if the product will not be used for an extended period, and keep spare batteries out of reach of small children. Seek prompt medical attention if a battery is swallowed.
The bucket is designed for normal outdoor use during trick-or-treating, including light rain. It is not designed for submersion in water or prolonged heavy rain exposure.
Stop use and contact us if you notice damage to the wiring, lights, or battery compartment.
4. Orders and contract formation
Displaying a product on the website is an invitation to place an order.
When you submit an order, you offer to buy the selected products. An automated order acknowledgement confirms receipt but does not necessarily mean the order has been accepted. The contract is formed when we confirm acceptance or dispatch, unless applicable law treats it as formed earlier.
We may reject or cancel an order before acceptance for a genuine reason, including:
- payment failure or suspected fraud;
- an obvious pricing or description error;
- product unavailability;
- a delivery destination we do not serve;
- a legal or safety restriction; or
- reasonable evidence of abuse of a promotion or commercial guarantee.
If we cancel an order after taking payment, we promptly refund the affected amount.
5. Prices, currencies, taxes and payment
Prices are shown in the currency displayed at checkout. The total amount payable, including product charges, delivery charges, and any sales tax we collect, will be shown before you place the order. Optional charges are not added without your express consent.
Payment is processed through the methods displayed at checkout. We may conduct reasonable authorisation, fraud-prevention and security checks.
6. Promotions, discounts and bundles
A promotion, discount, or bundle (including flash sales and multi-buy offers) may have a stated end date, qualifying product, minimum spend, usage limit or non-combination rule. Material conditions will be presented clearly before purchase.
We may withdraw a promotion prospectively, but will honour an accepted order unless there is a lawful reason not to. We may refuse duplicated, fraudulent or abusive use of a promotion.
7. Delivery
We deliver to the United States and, where shown as available at checkout, other destinations.
Delivery dates shown at checkout or in our Shipping Policy are estimates unless we expressly state a guaranteed date. We will ship and deliver within the period promised and comply with any mandatory delivery deadline that applies.
8. Cancellations, returns, refunds and guarantee
Our Refund Policy explains:
- remedies for defective, damaged, incorrect or misdescribed products; and
- our voluntary 60-Day Money-Back Guarantee, which provides a full refund of the product price once the item is returned to us.
The 60-Day Money-Back Guarantee is additional to, and does not reduce, any mandatory legal right you may have.
9. Reviews, testimonials and customer content
Reviews and testimonials published by us must reflect genuine experiences and must not mislead about the reviewer, product, results, incentive or source.
If you submit a review, comment, photograph or video, you confirm that:
- it reflects your genuine experience and honest opinion;
- it is lawful and does not infringe another person's rights;
- you disclose any reward, free product or commercial relationship; and
- you have permission from every identifiable person shown, including any child.
We may moderate content for relevance, privacy, abuse, illegality or authenticity. We will not suppress a genuine negative review merely because it is negative.
Submitting content through a review or submission tool gives us a non-exclusive permission to display it in the places and manner explained at submission. Use in paid advertising or materially different marketing requires the permission stated at submission or further permission from you.
10. Intellectual property
Website text, branding, original images, design, graphics, videos and other content are owned by or licensed to Spooky Dream and protected by applicable intellectual-property law.
You may access the website for personal shopping. You may not reproduce, scrape, republish, sell or commercially exploit protected content without permission, except where the law allows.
11. Acceptable use
You must not:
- use the website unlawfully, fraudulently or abusively;
- interfere with its security or operation;
- introduce malware or harmful code;
- submit false payment, identity, review or delivery information;
- infringe intellectual-property, privacy or other rights;
- scrape or harvest data in breach of law or our rights;
- misuse discounts, refunds, chargebacks or the commercial guarantee; or
- buy products for unauthorised resale.
12. Third-party services
We use third parties such as Shopify, payment processors, fulfilment providers and carriers. Their independent services may have their own terms. Using a supplier, platform or carrier does not transfer to the customer any responsibility that applicable law places on Spooky Dream as the seller.
13. Website availability and accuracy
We aim to keep the website available and accurate but do not guarantee uninterrupted access. Nothing in this section permits materially inaccurate product, price, delivery or legal information, or removes a remedy arising from an accepted order.
14. Responsibility and limitations
We are responsible for losses that applicable law makes us responsible for, including reasonably foreseeable losses resulting from our breach of these Terms.
Because products are sold for personal use, we are not responsible for business losses such as lost profit, lost revenue or business interruption, where the law permits that exclusion.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:
- death or personal injury caused by negligence where such liability cannot be excluded;
- fraud or fraudulent misrepresentation;
- defective or unsafe products where liability cannot be excluded; or
- any other mandatory consumer right or remedy.
Any limitation or exclusion applies only to the maximum extent permitted by applicable law.
15. Events outside reasonable control
If an event outside our reasonable control delays performance, we will take reasonable steps to reduce the effect and provide any notice or remedy required by law.
16. Changes to these Terms
We may change these Terms prospectively. The Terms in force when an order was accepted normally govern that order.
